Dance Positive Terms of Use
By accessing or using the Dance Positive platform ("Platform"), you agree to be bound by these Terms of Use and our Privacy Policy. If you are under 18 years of age, your parent or legal guardian must accept these terms on your behalf.

Mood Check-In Data Privacy
Within the platform, mood ratings are kept private from other families, stored securely, and never sold, shared publicly, or used for commercial marketing. Because a parent or guardian may help a child log in, a parent who shares a child's login may be able to see that child's check-ins. Deidentified data, with names and direct identifiers removed, may be shared with academic thought partners for independent analysis.
Acceptance of Terms
By creating an account or using the Dance Positive platform, you acknowledge that you have read, understood, and agree to these Terms of Use and our Privacy Policy. If you are under 18, your parent or legal guardian must accept these terms on your behalf.
For users under 13, additional COPPA-compliant consent procedures apply, including verifiable parental consent before data collection begins.
User Account Responsibilities
Account Security: You are responsible for maintaining the security of your login credentials and must notify us immediately of any unauthorized access.
Accurate Information: You agree to provide accurate, current information and update it as necessary to maintain account accuracy.
Appropriate Use: Accounts must be used only for their intended educational and research purposes in connection with enrolled dance classes.
Permitted and Prohibited Uses

Prohibited Uses
- Sharing login credentials with others
- Attempting to access other users' data
- Using the platform for commercial purposes
- Interfering with platform security or operation
- Submitting false or misleading information
SMS / Text Message Terms
Program. Dance Positive offers an optional SMS text notification program ("Dance Positive Notifications") for staff members — instructors and administrators. Messages are operational and work-related, such as class schedule changes, substitute and shift requests, class cancellations, attendance reminders, and payroll or scheduling notices.
Consent. You enroll through an in-app consent screen after logging in; the consent checkbox is unchecked by default and must be actively selected. Consent to receive SMS messages is not a condition of employment or of platform access, and you may decline without affecting your use of the Platform.
Frequency and rates. Message frequency varies. Message and data rates may apply, depending on your mobile carrier and plan.
Opting out and help. You can cancel the SMS service at any time by replying STOP. For assistance, reply HELP or contact support@dancepositive.org.
Carrier disclaimer. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your carrier and is not guaranteed.
Data handling. Mobile phone numbers and SMS opt-in consent are handled as described in the SMS section of our Privacy Policy: they are used solely to deliver the requested messages, are not shared or sold to third parties for marketing, and are kept separate from research data.
Research Participation
Voluntary Participation: Research participation is entirely voluntary and separate from basic platform use. You may withdraw from research at any time without affecting your access to dance classes or basic platform features.
Ethical Oversight: All research activities are conducted in accordance with research ethics standards ensuring ethical standards and participant protection.
Data Use: Research data is used solely for advancing scientific understanding of dance's psychological benefits and is never used for commercial purposes.
Publication: Research findings may be published in academic journals or presented at conferences in deidentified form.
Intellectual Property
Platform Content: The Dance Positive platform, including software, text, images, and design elements, is owned by Dance Positive and protected by copyright and trademark laws.
User Content: You retain ownership of any content you submit (photos, survey responses, etc.) but grant us a license to use it for platform operation and research purposes.
Restrictions: You may not copy, modify, distribute, or create derivative works from our platform content without express written permission.
Disclaimers and Limitations
Educational Platform: Dance Positive is an educational analytics platform and does not provide medical, psychological, or therapeutic services.
No Warranties: The platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation.
Limitation of Liability: Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages.
Termination
Account Closure: You may close your account at any time by contacting support. We may terminate accounts for violation of these terms or discontinuation of dance class enrollment.
Data Handling: Upon termination, personal data will be deleted according to our retention policies, with enhanced protections for children's data.
Changes to Terms
We may update these Terms of Use periodically. Significant changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of revised terms.
Governing Law
These Terms of Use are governed by the laws of California, United States. Any disputes will be resolved in the state or federal courts of Alameda County, California.
